Stringent Provisions Not Subdued Provisions

New Delhi: A trial court up the police for not invoking stringent provisions of the law against an upper caste man, Bharat Sethi, who allegedly offered poisoned tea to his Dalit wife and daughter. The police merely invoked Section 498A (which deals with cruelty) of the Indian Penal Code and the section dealing with criminal breach of trust. They did not touch Sections 307 or 328 of the IPC or the provisions of the SC/ST Act. ASJ Surinder S Rathi said: "It seems, as far as Delhi police is concerned, in a matrimony, even if a hapless girl is beaten up or is poisoned and she survives, them the only offence made out is under Section 498A... And if unfortunately she does not survive to tell the take of woes, it would invoke Section 304B of the IPC. ... Police are not supposed to underplay the gravity of allegations and turn a blind eye to a woman in need. A strong objection is taken to the conduct of the local police in registering the FIR mechanically under subdued provisions instead of invoking appropriate provisions of law."
